What we know:
On
July 3, 2003, the Federal Communications Commission (FCC) issued a Report and
Order amending the regulations that implement the Telephone Consumer Protection
Act of 1991 (TCPA). Among the new regulations were significant changes to the
rules regarding faxes containing unsolicited advertisements. The new FCC
proposal eliminates the prior “established business relationship”
language, no longer making membership in an association sufficient enough to
send a fax that contains advertisements for products or services, or flyers
covering events that cost a fee, such as our educational opportunities, events
or even our monthly membership meetings.
The new rules, which will go into effect on
August 25, 2003 -
30 days after they were published in the Federal Register on July 25, 2003,
cover any fax sent unsolicited that contains “any material advertising the
commercial availability or quality of any property, goods, or services.”
While these changes may be suitable
for residential telephone numbers as the new Do Not Call registry provides, they
are certainly not acceptable for association-to-member facsimile
communications. Associations rely on faxes as a prime source of communication
and marketing to meet the needs of their members. It is
quite obvious that the proposed regulations will have a detrimental impact on
the way associations communicate with their members. GAA is currently working
for a satisfactory resolution to this issue.
